Current Florida law requires a tenant to deposit rent into the court registry during an eviction case or else waive any and all defenses other than payment. If the tenant fails to comply with the rent deposit requirement, the tenant can end up with a default  final judgment of eviction, regardless of any defenses the tenant may have and without any opportunity to have their case heard in court. Jeff Hearne, Director of Litigation at Legal Services of Greater Miami, Inc. and housing expert will break down the procedural complexities of the rent deposit statute, including Motions to Determine Rent, and will examine the constitutionality of Florida's rent deposit requirement.
